2. What these terms cover

These terms govern your use of this website. By accessing or using the site, you agree to them. If you do not agree, please stop using the site.

These terms are not a services agreement. Nothing on this website is an offer capable of acceptance. Our infrastructure services — the Core, Secure and Full Sovereignty tiers and anything else we describe here — are provided only under a separate written agreement signed by both parties, together with a Data Processing Agreement under Article 28 GDPR and, where agreed, a Service Level Agreement. Where those documents conflict with these terms, those documents prevail for the services they cover.

We contract with organisations, not consumers. If you are a consumer within the meaning of Bulgarian consumer protection law, nothing in these terms limits the statutory rights you have that cannot be excluded by agreement.

3. Using this website

You may read, print and share the pages of this site for your own information and for evaluating whether to work with us.

You may not:

  • use the site in a way that breaks any applicable law;
  • attempt to gain unauthorised access to the site, its server, or any connected system;
  • probe, scan or test the vulnerability of our systems without our prior written permission — if you are a security researcher, contact us first and we will talk;
  • interfere with the site’s availability, including by overloading it or by automated requests at a rate that degrades service for others;
  • scrape the site in bulk, or use it to train a machine learning model, without our written permission;
  • submit anything through our forms that is unlawful, misleading, or infringes anyone’s rights;
  • misrepresent your identity or your affiliation with any organisation.

We may restrict or block access where we reasonably believe any of the above is happening.

4. Enquiries you send us

When you submit our contact form or email us, you confirm that the information you give is accurate and that you are authorised to send it on behalf of any organisation you name.

Sending an enquiry creates no contract and no obligation on us to provide services. We will reply to genuine enquiries but do not guarantee a response time on this website.

We handle the personal data in your enquiry as described in our Privacy Policy.

5. Intellectual property

5.1 Our content

The text, layout, graphics, structure and design of this website, and the Aperseco name and logo, are owned by Aperseco EOOD or licensed to us, and are protected by Bulgarian and EU copyright and trade mark law. Reading and sharing the pages is fine. Republishing our content as your own, or using our name or logo to suggest an endorsement or partnership that does not exist, is not.

5.2 Open-source software we deploy

Our services are built on independent open-source projects. Each of those is the work of its own community and is licensed to you under its own licence, not by us. Deploying and managing software for you does not make us its author or licensor, and grants you no rights in it beyond what its licence gives you.

Names such as Nextcloud, OnlyOffice, OpenProject, Drupal, Wazuh, Vaultwarden, Grafana, Matrix, Jitsi, Matomo, Mixpost, Listmonk, Dolibarr, n8n, LimeSurvey and Moodle are the trade marks of their respective owners. We reference them to describe what we deploy. We are not affiliated with, endorsed by, or acting as an official partner of those projects unless we say so explicitly and by name.

5.3 Your material

If you send us content — a brief, a specification, a logo for a mock-up — you keep every right in it. You grant us only the limited permission we need to read it and respond to your enquiry.

6. Accuracy and availability of this website

We work to keep this site accurate and current, but it describes our services in general terms and is not a technical specification. Feature lists, tier contents and descriptions may change, and the details that bind us are those in your signed agreement.

We do not guarantee that this website will be available without interruption or free of errors. We may change, suspend or withdraw any part of it at any time without notice. Availability commitments for the services we operate for clients are set out in the applicable Service Level Agreement, not here.

7. Links to other sites

This site links to third-party websites, including our partner Unicis.Tech and the projects listed in Section 5.2. We provide those links for convenience. We do not control those sites, we are not responsible for their content or their privacy practices, and a link is not an endorsement of everything on the other side of it.

8. Liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under Bulgarian law.

Subject to that, and in relation to your use of this website only:

  • we provide the website on an “as is” basis, without warranties of any kind, whether express or implied;
  • we are not liable for any indirect or consequential loss, or for loss of profit, revenue, business, goodwill, data, or anticipated savings, arising out of your use of or inability to use this website;
  • we are not liable for any loss caused by malware, a distributed denial-of-service attack, or other technically harmful material that infects your equipment through your use of this website, beyond the reasonable security measures we take.

Our liability for the services we provide under contract is governed exclusively by that contract, which contains its own liability provisions. This section does not cap, extend or otherwise affect it.

9. Privacy and data protection

Our Privacy Policy explains what personal data we process through this website, why, and what rights you have. It forms part of these terms.

Where we operate infrastructure for a client, we act as a processor under Article 28 GDPR on that client’s documented instructions, under a written Data Processing Agreement. That relationship is governed by that agreement, not by these terms.

10. Changes to these terms

We may revise these terms. The date at the top shows the current version. Changes take effect when published, and your continued use of the site after that means you accept them. Changes to these website terms do not alter any signed services agreement.

11. Governing law and jurisdiction

These terms and any dispute arising out of them or out of your use of this website are governed by the law of the Republic of Bulgaria, without regard to its conflict-of-laws rules.

The competent courts of Sofia, Bulgaria have exclusive jurisdiction, save that where you are a consumer, you retain any right you have under mandatory law to bring proceedings in the courts of your place of residence.

12. General

If any provision of these terms is found to be invalid or unenforceable, the rest remains in force and the invalid provision is replaced by a valid one that comes closest to its commercial purpose.

Our failure to enforce a provision is not a waiver of it.
